PRIVACY INFORMATION PURSUANT TO THE EUROPEAN REGULATION 2016/679 AND THE CURRENT PRIVACY LEGISLATION

Pursuant to and for the purposes of the provisions of art. 13 of the 2016/679 European Regulation regarding the protection of personal data (“GDPR”) and of the national Privacy Law (hereinafter “Current Privacy Law”), we inform you that your personal data will be processed through electronic and manual tools, in Italy, also through the use of social networks. This information, prepared on the basis of the principle of transparency and all the elements required by the GDPR, is divided into individual sections, each of which deals with a specific topic in order to make reading faster, easier and easier to understand (hereinafter the “Information”).

Who is the Data Controller?
The Data Controller is Base nautica srl (hereinafter “Nautical Base”) with registered office in Via Pontina 148 Km 78.200 – 04100 Latina

What is the legal basis of the treatment?
The legal bases for the processing of your personal data are:
– the Consent you issued for the processing of your data when accessing and/or using the services of the Nautical Base
– for the fulfillment of regulatory obligations including accounting, administrative and tax obligations

For what purposes will your data be processed?
1) Your personal data will be processed for the following purposes:
a) be updated on the activities we carry out
b) suggestions and technical assistance to the Service. In some cases, to receive suggestions or reports from users on malfunctions of our products, we will acquire information relating to the Mac Address or ID of the device, IP address, operating system, type of device and email;
c) participation in any competitions
d) request and/or participation in events, educational initiatives, etc.;
e) sending of multimedia content (photos, video, audio, etc.) sent through sites, mobile apps, social networks, communities, newsrooms, emails, forms, etc.;
f) participation in web publishing activities
the. sending comments on sites, apps and social networks;
ii. sending emails, requesting information via form;
g) management of any complaints and disputes;
h) technical analysis of the use of the services in anonymous mode through the use of tools such as Facebook Analytics and Google Fabric/Crashlytics;
i) sending of newsletters.
2) Furthermore, your personal data with your optional consent will be processed for the purposes of:
a) collection and analysis of behaviors and habits in the use of web contents, of our services, also through cookies or other electronic ids (mac address, ip/id, etc), recommendation engines, statistics, preferences issued by the customer for the purpose of carry out market research, improve the services provided and personalize them, as well as reduce the number of repetitions of advertising messages and facilitate the forwarding of information and commercial offers referred to in point b).
The processing of your personal data for personalization and profiling purposes will take place with tools and with automated methods and with data processing tools that will create your commercial and behavioral profile on the web. This data processing tool relates the data collected during your navigation on the Site through the use of profiling cookies.
b) communication and/or sending (by e-mail, sms, notifications, mail, telephone contact, etc.), also with automated methods, of information and commercial offers, advertising and promotional material on its own services and/or of third parties, as well as carrying out market research.
The provision of your data is necessary for the achievement of the purposes referred to in point 1).
Your missing, partial or incorrect conferment could result in the impossibility of activating and providing the requested service. Furthermore, the provision of your data for the specific purposes referred to in point
2) is optional, but any refusal will make it impossible for the Nautical Base to process your request and contact you. In any case and as better specified below, you can revoke your consent, even partially, for example by consenting only to traditional contact methods.

To which subjects may your Personal Data be disclosed?
Your personal data will be processed exclusively by persons authorized to process it and by persons designated as Data Processors in compliance with the GDPR in order to correctly carry out all the Processing activities necessary to pursue the purposes referred to in this Information. Your Personal Data may be disclosed to public bodies or judicial authorities, where required by law or to prevent or suppress the commission of a crime.

Further communications
With your free and optional consent, your personal data (name, surname, address, e-mail, telephone, province, gender, username, IP and Device ID) will be communicated by Base nautica to the following categories of subjects and/or companies third:
– anyone who is a legitimate recipient of communications required by law or regulation (such as, for example, offices and public authorities);
– anyone who is the recipient of communications necessary to fulfill the obligations deriving from the Service;
– third-party companies specialized in the management of commercial and credit-related information (such as, for example, data processing centres, banks, etc.).
Furthermore, they may also be communicated for the same purposes to:
– companies and/or collaborators for the management of administrative services which are used to fulfill one’s legal or contractual obligations;
– other subjects (companies, companies, natural persons) who collaborate in the creation of the Service.
These individuals operate as appropriately appointed and trained Managers.

minors
The Personal Data of minors under the age of 16 will not be processed by the Data Controller, unless authorized by the holder of parental responsibility.

Legitimate interest of the Owner
The Data Controller has a legitimate interest in transferring personal data to companies within the Nautical Base Group for internal administrative purposes.

How long will your Personal Data be processed?
Your personal data will be kept for the period necessary to pursue the purposes relating to point 1) above. In particular, your Personal Data will be processed for a period of time equal to the minimum necessary to achieve the purposes, without prejudice to a further retention period which may be imposed by law.
Furthermore, if you decide to give your optional consent referred to in point 2) relating to the purposes of marketing, profiling and/or communication to third parties, your Personal Data will be kept, unless consent is revoked, for a period of time higher than what is necessary to achieve the objectives.
Your Data will be kept for a further period in relation to the purposes of disputes and any legal obligations.

How can you revoke the consent given?
You have the right to revoke your consent given to the Data Controller at any time in whole and/or in part without prejudice to the lawfulness of the processing based on the consent given before the revocation.

Where will your data be processed?
Your Personal Data will be processed by the Data Controller within the territory of the European Union.
If for technical and/or operational reasons it is necessary to make use of subjects located outside the European Union, we inform you right now that these subjects will be appointed as Data Processors pursuant to and for the purposes of article 28 of the GDPR and the transfer of your Personal Data to these subjects, limited to the performance of specific processing activities, will be regulated in accordance with the provisions of the GDPR.

All the necessary precautions will be taken in order to guarantee the total protection of your Personal Data basing this transfer on the evaluation of appropriate guarantees including, by way of example, adequacy decisions of the recipient third countries expressed by the European Commission; adequate guarantees expressed by the recipient third party pursuant to Article 46 of the GDPR.

In any case, you can request further details from the Data Controller if your Personal Data have been processed outside the European Union, requesting evidence of the specific guarantees adopted.

What are your rights?
We remind you that you can exercise your rights under the GDPR and in particular to obtain:
– confirmation that Personal Data Processing concerning you is or is not in progress and to obtain access to the data and the following information (purpose of the Processing, categories of Personal Data, recipients and/or categories of recipients to whom the data have been and/or will be communicated, retention period);
– the rectification of inaccurate Personal Data concerning you and/or the integration of incomplete Personal Data, also by providing a supplementary declaration;
– the cancellation of Personal Data, in the cases provided for by the GDPR;
– the limitation of the Treatment in the hypotheses foreseen by the current Privacy Law;
– the portability of data concerning you, and in particular to request the personal data concerning you provided to the Data Controller and/or request the direct transmission of your data to another data controller;
– the opposition to the processing at any time, for reasons connected to your particular situation, to the processing of personal data concerning you in full compliance with the current Privacy Law, as well as for purposes relating to marketing and profiling.

In any case, you will always have the right to lodge a complaint with the competent supervisory authority (Guarantor for the Protection of Personal Data), pursuant to art. 77 GDPR, if you believe that the processing of your data is contrary to the current Privacy Law.
